Terms of Service
The Parties
These Terms of Service ("Terms") are a legal agreement between you (the "Customer") and Nico Genz IT Solutions ("Pushrift", "we", "us"), the company behind the Pushrift platform. By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of a company or organization, you represent that you have the authority to bind that entity.
What Pushrift Does
Pushrift is a developer platform for managing and distributing updates to desktop applications. The Service includes a web dashboard, a REST API, and an SDK that integrates into your application to check for and deliver updates.
Your Account
You need an account to use Pushrift. You are responsible for keeping your credentials secure and for all activity that takes place under your account. If you suspect unauthorized access, notify us at [email protected] immediately.
You may invite members to your organization. You are responsible for ensuring that all members comply with these Terms.
Free Tier and Paid Plans
Pushrift offers a free tier with limited usage. If you exceed the limits of the free tier or choose a paid plan, you will be billed in advance on a monthly or annual basis.
All fees are charged in the currency displayed at checkout and are exclusive of applicable taxes, which are your responsibility.
Billing, Cancellation, and Refunds
You may cancel your subscription at any time from your account settings. Cancellation takes effect at the end of your current billing period — you retain full access until then.
All fees are non-refundable. We do not offer pro-rata refunds for unused time within a billing period.
We reserve the right to change our pricing. We will give you at least 30 days' notice of any price increase by email. If you do not cancel before the new pricing takes effect, you accept the new price.
Acceptable Use
Your use of Pushrift is governed by our Acceptable Use Policy. In short: do not use Pushrift to distribute malicious software, deceive your users, or abuse our infrastructure.
Your Content and Data
You retain ownership of all applications, update packages, and other content you upload to Pushrift. By uploading content, you grant Pushrift a limited, non-exclusive, royalty-free license to store, process, and deliver that content solely to provide the Service to you.
You are solely responsible for the content you distribute through Pushrift and for ensuring you have the rights to do so.
Privacy and Data Processing
How we handle personal data is described in our Privacy Policy. If you use Pushrift to process personal data of your end users, the terms of our Data Processing Agreement apply and are incorporated into these Terms.
Intellectual Property
Pushrift, its dashboard, API, SDK, and all associated software are owned by Nico Genz IT Solutions and protected by applicable intellectual property laws. These Terms do not grant you any rights to our trademarks, brand, or technology beyond what is needed to use the Service.
Availability
We aim to keep Pushrift available and reliable, but we do not make any formal uptime commitments. The Service is provided on a best-effort basis. We may perform maintenance that results in temporary unavailability, and we will try to do so during off-peak hours where possible.
Suspension and Termination
We may suspend or terminate your account if you breach these Terms or our Acceptable Use Policy, if your account is overdue on payment, or if we reasonably believe your use of the Service poses a risk to others or to the platform.
Where possible, we will notify you before taking action and give you an opportunity to remedy the situation. In cases of serious or repeated violations, we may act without prior notice.
Upon termination, your access to the Service ends. Your data will be deleted within 30 days in accordance with our Privacy Policy.
Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.
Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, NICO GENZ IT SOLUTIONS' TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE FEES YOU PAID TO PUSHRIFT IN THE THREE MONTHS PRECEDING THE CLAIM.
WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Nothing in these Terms limits liability that cannot be excluded under applicable law, including liability for fraud or willful misconduct.
Governing Law and Disputes
These Terms are governed by the laws of the Federal Republic of Germany, excluding its conflict of law provisions. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Germany.
If you are a consumer in the EU, you may also benefit from mandatory protections provided by the law of your country of residence.
Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes by email at least 14 days before they take effect. If you do not agree to the updated Terms, you may cancel your account before they take effect. Continued use of the Service after the effective date constitutes acceptance.
